01 Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a clinic, practice, or other organization, you represent that you have authority to bind that entity, and "you" refers to that entity. If you do not agree, you must not use the Service.

02 Definitions

• "Account" means the registered profile you use to access the Service.
• "Content" means photos, videos, notes, records, and other material uploaded to or generated within the Service.
• "Patient Data" means information relating to an identifiable individual, including before/after imagery and treatment records.
• "AI Studio" means the AI-powered photo and video generation features of the Service.

03 Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. The Service is intended for use by licensed medical and aesthetic professionals and their authorized staff. You are responsible for ensuring that your use complies with all laws, regulations, and professional standards applicable to your practice.

04 Accounts & Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You agree to provide accurate information, keep it up to date, and notify us promptly of any unauthorized use or security breach. We may suspend or disable an Account that we reasonably believe has been compromised or used in violation of these Terms.

05 Use of the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal professional purposes. The Service is a documentation and content tool; it does not provide medical advice, diagnosis, or treatment, and must not be relied upon as a substitute for professional clinical judgment.

06 Patient Data & Consent

You are solely responsible for obtaining and maintaining all necessary consents, authorizations, and legal bases required to capture, upload, store, and process Patient Data through the Service, including any consent required to use imagery for treatment records, AI processing, or marketing.

• You will only upload Patient Data that you are authorized to process.
• You will comply with applicable privacy and health-data laws (e.g., HIPAA, PIPEDA, GDPR) as relevant to your jurisdiction.
• Where required, a separate data-processing or business-associate agreement may apply and will govern the handling of Patient Data.

07 AI Studio Content

AI Studio uses artificial intelligence to generate and enhance photos and videos. AI-generated output may contain inaccuracies or artifacts and should be reviewed before use. You are responsible for verifying that any AI-generated or enhanced Content is accurate, appropriate, and clearly distinguishable from unaltered clinical imagery where such distinction is required by law or professional standards. You must not use AI Studio to create misleading representations of treatment outcomes.

08 Subscriptions & Billing

Paid plans are billed in advance on a recurring basis (monthly or as otherwise stated at checkout) and renew automatically until cancelled. Fees are non-refundable except where required by law. We may change pricing with reasonable prior notice; changes take effect at your next billing cycle. You authorize us and our payment processors to charge your selected payment method for all applicable fees and taxes.

09 Intellectual Property

The Service, including its software, design, and trademarks, is owned by Afterx and its licensors and is protected by intellectual-property laws. You retain ownership of the Content you upload. You grant us a limited license to host, process, and display your Content solely to operate and improve the Service and to provide it to you. We may use aggregated, de-identified data to enhance the Service.

10 Prohibited Conduct

• Uploading Content you lack the right or consent to use.
• Reverse engineering, scraping, or attempting to access the Service in an unauthorized way.
• Interfering with, disrupting, or overloading the Service or its security features.
• Using the Service for any unlawful, deceptive, or harmful purpose.

11 Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described there.

12 Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or where required by law. Upon termination, your right to use the Service ends. We will make your Content available for export for a reasonable period unless prohibited by law, after which it may be deleted in accordance with our retention practices.

13 Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated output will be accurate or suitable for any particular use.

14 Limitation of Liability

To the maximum extent permitted by law, Afterx and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

15 Changes to the Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
